Terms of Service

1. Acceptance of Terms

By accessing or using asks.fun ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

asks.fun is a decentralized survey platform that enables users to create and respond to surveys ("Asks") using cryptocurrency-based rewards.

2. Eligibility

You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Wallet Connection

To use certain features, you must connect a compatible cryptocurrency wallet. You are solely responsible for:

• Maintaining the security of your wallet and private keys
• All activities that occur using your connected wallet
• Any transactions initiated from your wallet

We never have access to your private keys. If you lose access to your wallet, we cannot recover your account or funds.

4. Sparks Currency

Sparks is an in-platform currency used for creating surveys and rewarding respondents.

4.1 Purchasing Sparks

You may purchase Sparks using USDC at the rate of 1,000 Sparks = $1 USDC. All purchases are final and non-refundable.

4.2 Withdrawing Sparks

You may withdraw Sparks to USDC at the rate of 2,000 Sparks = $1 USDC, plus a $1 processing fee. Minimum withdrawal is 20,000 Sparks ($10).

4.3 No Monetary Value Guarantee

Sparks are not securities and do not represent ownership in asks.fun. We reserve the right to modify exchange rates and fees with reasonable notice.

5. User Conduct

You agree not to:

• Create surveys with illegal, harmful, or fraudulent content
• Submit false or misleading survey responses
• Use bots, scripts, or automated tools to manipulate the platform
• Attempt to exploit, hack, or interfere with the Service
• Circumvent eligibility requirements using multiple wallets
• Harass, abuse, or harm other users
• Violate any applicable laws or regulations

6. Survey Content

Survey creators are responsible for the content of their surveys. We reserve the right to remove surveys that violate these Terms or applicable laws.

By creating a survey, you grant us a license to display and distribute your survey content on the platform. Survey responses remain encrypted and owned by the respondents.

7. NFT Achievements

NFT achievements are digital collectibles that may provide platform benefits. Ownership of NFTs does not grant any equity, governance rights, or claims against asks.fun unless explicitly stated.

8. Disclaimers

We are not responsible for any losses resulting from:

• Blockchain network issues or smart contract vulnerabilities
• Loss of wallet access or private keys
• Fluctuations in cryptocurrency values
• Third-party services or integrations

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ASKS.FUN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

10. Modifications

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting an update on the platform. Continued use after changes constitutes acceptance of the new Terms.

11. Termination

We may suspend or terminate your access to the Service at our discretion, with or without cause. Upon termination, you may still withdraw any earned Sparks balance, subject to our standard withdrawal terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where asks.fun is registered, without regard to conflict of law principles.
